Curiae Episcopalis et Provicarialis Notabilis Civitatis, Acta Originalia, 1587-1824

Scope and Contents

In 14 volumes. Records of civil and criminal proceedings of the episcopal courts of Malta, the Curia Episcopalis Civitatis Notabilis and Curia Provicariales. Records include legal proceedings and trials concerning benefices, renunciations, taxes, property, petitions, donations, marriages, privileges, legal declarations, among other major affairs related to the jurisdiction of the bishop of Malta. Records arranged chronologically. Related documents in the Curia Episcopalis Melitensis, Acta Originalia, at the Cathedral Archives (Mdina)

Historical Note

The bishop of Malta had more than one curia. The oldest was in Mdina, in the palace next to the Cathedral. A curia was established in Valletta after its foundation, and another was located in Gozo, administered by the provicar for Gozo. The curia in Mdina had two sections: the Curia Episcopalis Civitatis Notabilis presided over by the bishop or his vicars from the fifteenth to the seveneteenth century, and the Curia Episcopalis et Provicariales Civitates Notabilis (Curia Provicariales) headed by the Provicarius Civitatis Notablis from the late seventeenth through the eighteenth century, though the office of provicar began in 1591. The office of Provicarius Civitatis Notablis had jurisdiction over Mdina, Rabat, Dingli, and Siġġiewi. Curia Episcopalis et Provicariales Civitates Notabilis was suppressed in 1828 April 10. The Valletta curia was called the Magna Curia. The Magna Curia in Valletta was later moved to the Episcopal Palace in Birgu. Documents issued from the Magna Curia in Birgu were designated "in nova citate"; The curia in Victoria was part of the Curia Provicariales.

Custodial History

The collection originates from at least four different archives prior to the French occupation of Malta in 1798: Episcopal Palace, Mdina, 1400-1798; Episcopal Palace, Birgu, ca. 1550-1798; Episcopal Palace, Valletta, ca. 1645-1798; Curia Provicarilis, Victoria, -1798; The French government confiscated the records in 1798 and entered them into the Depôt Générale des Chancelleries et Tribunaux Supprimés, 1798-1802; Governor Alexander Ball released the records in 1802, and 1037 volumes entered into the possession of the Archdiocese of Malta, however, fourteen volumes remained in government hands; National Archives of Malta, Legal Documentation Section at the Banca Giuratale in Mdina, 19th century-present
